Comprehensive Guide to Maternity Leave in India: Laws, Benefits, and Eligibility

Maternity Leave in India comes under the Maternity Benefit Act 1961 (“Act”). It provides comprehensive benefits, including paid leaves, medical bonuses, and nursing breaks. It protects the livelihood of female employees during their journey of pregnancy and motherhood.  This act states that a working who works at recognized organizations and factories is allowed to avail of leave for up to six months.

This Act applies to all government organisations, mines, private companies, factories, plantations, and organisations with more than 10 employees. It was amended in 2017 to include various parameters, such as an increase in the maternity leave period, the introduction of work-from-home opportunities, and maternity leave benefits for mothers in case of adoption.

Guidelines

  • Pregnant women are eligible for 26 weeks of maternity leave, of which they can take a maximum of 8 weeks prior to the expected delivery date.
  • In the case of 3rd or subsequent child, a woman is eligible to get only 12 weeks of maternity leave.
  • In the case of a medical termination of pregnancy or miscarriage, a woman is allowed to take 6 weeks of maternity leave.
  • In the case of adoption or commissioning, mothers are allowed to take leave for up to 12 weeks.

Rules

  • Women should be paid in full during their maternity leave, which is calculated as per the actual salary or daily wages during the 3 months prior to the maternity leave request.
  • A woman should not be employed during the 6 weeks immediately following her delivery or miscarriage.
  • The employer should provide the child care benefits, and the woman should be given her previous position back in the organization.
  • Pregnant women can avail of amenities like hygienic restrooms, safe drinking water, and comfortable seating arrangements.
  • Employers should not provide difficult tasks or long working hours 10 weeks prior to the expected delivery date to ensure the health and safety of mother and child.
  • Additional leaves can also be provided to mothers who are unable to rejoin after maternity leave as per mutual agreement.
  • Mothers can also avail of work-from-home facilities through a mutual agreement between employer and mother.

Any employed woman who just gave birth to a newborn baby is eligible under the Maternity Benefit Act 2017 if she is working with the employer for at least 80 days in the 12 month period before the expected date of delivery.
