It is really a special day in India today. The Supreme Court (SC) has said that consensual adult gay sex is not a crime.ย The Supreme Court has hereby defanged the British-era Section 377 of the Indian Penal Code (IPC), which said that gay sex is a punishable crime. Todayโs judgment is a liberation for the LGBTQ (Lesbian, Gay, Bisexual, Transgender) community of India who has been fighting to legalize gay sex in the country.

Gay Sex Decriminalised In India, LGBTQ RejoiceA five-judge bench led by CJI Dipak Misra passed the judgment today excluding all kinds of adult consensual sexual behavior. The law still stands on the statute book to deal with unnatural sexual offenses against minors and animals.
CJI Dipak Misra said,
“Section 377 is irrational, arbitrary, and incomprehensible as it fetters the right to equality for the LGBT community. LGBT community possesses the same equality as other citizens.”
